Collins Correctional Facility Death Prompts Criminal Investigation
An incarcerated man died after an alleged attack inside a rehabilitation unit as State Police, prison investigators and the Attorney General’s Office responded.
New York State Police are investigating the Collins Correctional Facility death of 34-year-old Jose R. Aponte following an alleged attack by another incarcerated person late Tuesday night.
The deadly incident occurred inside a Residential Rehabilitation Unit at the state prison in Collins, according to a State Police news release issued Wednesday, July 22. Investigators have not announced any criminal charges or released the identity of the person accused of attacking Aponte.
What authorities say happened
The New York State Department of Corrections and Community Supervision notified the State Police Bureau of Criminal Investigation at approximately 11 p.m. on July 21.
According to the preliminary investigation, one incarcerated person attacked another inside the prison’s Residential Rehabilitation Unit. Aponte suffered serious physical injuries during the altercation.
He was transported to Bertrand Chaffee Hospital, where medical personnel attempted life-saving measures. Aponte was later pronounced dead, State Police said.
Authorities have released only limited details about the circumstances surrounding the alleged attack.
State Police have not publicly disclosed:

Multiple agencies involved in the investigation
The Collins Correctional Facility death is being investigated by the State Police Bureau of Criminal Investigation.
The DOCCS Office of Special Investigations is assisting with the case. That office examines alleged criminal activity, misconduct and other serious incidents connected to New York’s state correctional system.
The New York Attorney General’s Office was also notified and sent representatives to the prison, according to State Police.
Under Section 70-b of New York’s Executive Law, the Attorney General’s Office of Special Investigation assesses incidents in which a police officer or peace officer, including a correction officer, may have caused a person’s death through an action or failure to act. Notification does not mean that authorities have accused a correction officer of causing Aponte’s death. It allows the office to determine whether the incident falls within its legal authority.
That distinction is important. The State Police release describes the incident as an attack by one incarcerated person against another. It does not allege that a correction officer used deadly force or directly caused Aponte’s injuries.
What remains unknown
The initial report provides a basic timeline, but many questions surrounding the Collins Correctional Facility death remain unanswered.
Investigators will likely examine surveillance video, staff reports, medical records and statements from incarcerated witnesses. They may also review staffing levels, security procedures and the response after Aponte was injured.
