State Police Arrest Callicoon Man for Road Rage Incident in the Town of Fremont

On January 12, 2025, at approximately 2:39 p.m., New York State Police from the Liberty barracks responded to a road rage incident on Warner Road in the town of Fremont.

The preliminary investigations revealed that a 23-year-old female and a 26-year-old male victim had previously engaged in a verbal and physical altercation with 51-year-old John Paterno of Callicoon, NY, near his residence. Both parties separated following the dispute, and the victims left the scene shortly after. The situation escalated when Paterno followed the victims in a 2018 Ford Fusion and fired multiple rounds from a handgun at their 2008 Honda CRV, resulting in a collision between the two vehicles. Both parties separated after the incident and police were called.

Paterno was located at his residence and arrested without incident. He was charged with Criminal Possession of a Weapon in the 2nd Degree (C felony), Criminal Mischief in the 3rd Degree (E felony), and Reckless Endangerment in the 1st Degree (D felony). Police later recovered the firearm used in the incident at Paterno’s residence.

Paterno was arraigned at the Town of Liberty Court and remanded to Sullivan County Jail on $50,000 cash bail, $100,000 bond, or $250,000 partially secured bond. He is scheduled to return to court on January 15, 2025, at 2:00 p.m.


Fatal collision in Freedom

On January 14, 2025, at 4:28 P.M., Troopers out of SP Machias responded to a single vehicle collision on State Route 98 in the town of Freedom. Investigation determined that a 2011 Ford F150 was traveling eastbound on State Route 98, entered the westbound lane and continued to exit the roadway striking a culvert and tree. The single occupant and operator, Thomas E. Kilmer, 69 of Scio, NY was transported to Chaffee Hospital and pronounced deceased. An autopsy has been scheduled at Erie County Medical Center.


State Police investigate a snowmobile incident in the town of Stockholm

On January 14, 2025, at approximately 2:08 p.m., State Police members responded to County Route 49 in the town of Stockholm for a possible snowmobile operator who fell through the ice.  Troopers arrived on the scene of the St. Regis River, near the County Route 49 bridge, and observed snowmobile tracks on the ice which led to open water.  A red 2020 snowmobile was located at the bottom of the river near the north shoulder of the bridge.  Local dive teams from Parishville, Akwesasne, and the St. Lawrence County Sheriff’s Office arrived on the scene to help search for the operator of the snowmobile.  Parishville Fire Department deployed a drone into the water to search for the victim.  Due to the fast flow of the current and the loss of daylight, the search was suspended until this morning.

On today’s date, January 15, 2025, the New York State Police Underwater Recovery Team (URT) responded to St. Regis River to continue search efforts for the victim.

This is an ongoing investigation.


Contractor arrested for Grand Larceny

On January 10, 2025, the Bureau of Criminal Investigation arrested James O. Gwise, 30 of Delevan, NY for Grand Larceny 2nd degree (C Felony).

On December 11, 2023, Troopers received a complaint of larceny of construction funds in the town of Yorkshire. Investigation determined that the Gwise, the owner of Enchanted Mountain Construction took money from customers for home construction in the town of Allegany and did not fulfill the agreements.

Gwise was arrested and arraigned in the town of Allegany Court and was released on his own recognizance. Gwise next court date will be in February 2025.

Utica male arrested for criminal possession stolen property 3rd and 4th

On January 13, 2025, State Police members arrested Mark T. Albicker, age 60, of Utica, NY, for criminal possession of stolen property 4th and criminal possession of stolen property 3rd. 
 

On January 13, 2025, at approximately 5:57 p.m., Troopers responded to State Route 30 in the town of Santa Clara for a report of a stolen vehicle out of Malone, NY. Troopers located the stolen white 2019 Chevrolet Silverado pickup truck traveling south on State Route 30 and initiated a traffic stop, which the operator complied. The driver was identified as Albicker, and he was taken into custody without incident.

Albicker was arrested and transported to SP Ray Brook for processing. He was arraigned in the Town of Harrietstown Court, where he was released on his own recognizance. Albicker was later transported to Malone Police Department for pending charges.
