DEA Registers 900-Plus Medical Dispensaries, Not Recreational Sales

The Drug Enforcement Administration is issuing its first federal registrations to more than 900 qualifying medical marijuana dispensaries for DEA medical marijuana registrations, the Justice Department announced Oct. 30. The step is limited to a defined medical program. It is not nationwide legalization of recreational marijuana.

The initial group spans Alabama, Florida, Mississippi, South Dakota, Texas, Virginia and West Virginia. New York is not among those seven states. The announcement does not establish that a New York dispensary has received one of these registrations.

This new initiative will enhance the availability of DEA medical marijuana registrations for patients in need.

DOJ said applicants had to pass DEA review. A state license alone does not provide federal approval, and registered businesses must meet security, inventory and recordkeeping requirements. The department said it would process additional applications in phases.

Medical registration and broader rescheduling are different

The registrations implement an April order covering qualifying medical marijuana activity under Schedule III controls. DOJ said recreational activity is outside that order, marijuana outside its coverage remains under Schedule I controls, and broader rescheduling is a separate administrative proceeding. Read DOJ’s Oct. 30 announcement.

The underlying federal rule created an expedited registration route for state-licensed medical marijuana businesses. It includes federal oversight rather than simply treating state authorization as sufficient. The rule also lays out specific controls for manufacturers. The April 28 Federal Register rule provides the legal framework.

Important questions remain

The Associated Press reported that registration could bring major tax benefits for medical cannabis businesses. It also identified unresolved questions about how federal rules will apply to businesses that combine medical and adult-use operations. The news service reported that DOJ had not immediately identified the individual approved businesses. Read the AP report.

Those distinctions matter to readers following cannabis policy in New York. Friday’s development concerns a federal registration process for businesses in the initial group. It should not be read as an announcement that all cannabis products, all retailers or all purchases now have the same federal status.
