Utica, NY – September 17, 2024 — Chee War, the mother and legal guardian of 13-year-old Nyah Mway, has filed a Notice of Claim against the City of Utica, alleging multiple violations of civil rights and wrongful death in connection with the fatal police shooting of her son on June 28, 2024. The claim outlines a series of serious offenses, including excessive force, false arrest, and the failure of officers to intervene.
The tragic incident occurred when three Utica Police Department officers — Patrick Husnay, Bryce Patterson, and Andrew Citriniti — unlawfully stopped Nyah Mway for jaywalking at approximately 10:18 PM near the intersection of Shaw and Bennett Streets. The situation quickly escalated as Nyah Mway, in fear, attempted to run. After being caught by Officer Patterson, Nyah Mway was pinned to the ground and punched repeatedly in the face. Despite Nyah Mway posing no threat, Officer Husnay proceeded to shoot him in the chest, leading to his death.
The Notice of Claim, filed by Ms. Chee War in her capacity as the administrator of Nyah Mway’s estate, names the City of Utica and the Utica Police Department as responsible for the actions of the officers involved. The claim alleges numerous causes, including but not limited to:
